How To Take Advantage Of Lemon Laws When Your New Car Has Serious Defects

A car is a very expensive purchase. The car you purchase can be much more expensive if it turns out to be a lemon. When you have accidentally purchased a lemon, you will need to make sure that the car is a lemon and take steps to protect your rights.

A lemon has historically been used to refer to any product that does not work properly. Some cars are found to have defects after being driven off the lot but the defects are not considered to be severe enough for the car to be considered a lemon. If the car actually is a lemon, it needs to have repeated problems that cannot easily be solved. 

When a car has a substantial defect, this means that it will significantly impact the driveability of the car, how safe the car is to drive, or how much the car is worth. Some cars have faulty brakes, for example, and it's impossible to drive the car without ending up in an accident when the brakes inevitably fail.

What Should You Do?

To be able to take legal action, you will need to act quickly. The car must fail after only a short period of time and you must prove that the car was already defective when you drove it off the lot. You will need to make repairs to your car. However, after you have made several attempts to repair your car, it will be considered reasonable to consider that your car cannot be repaired. If the defect is considered to be very serious, you might only be expected to make a single repair. Once you have determined this, you will then be able to take legal action against the dealer.

Will You Have to Pay for Repairs?

You will be able to file a claim with your insurance provider to pay for any problems that need to be repaired with your new car. However, you will also be able to legally mandate that the car dealer reimburse your insurance provider.
